SMALL WORLDS Inc. (hereinafter referred to as "the Company") establishes the "Figure Program with Residency Rights Terms of Service" (hereinafter referred to as the "Terms") as follows. Please read the full text of this agreement. Only those who accept these Terms can take part in the Company's figure program with residency (hereinafter referred to as the "Service").

Article 1: Scope of Application and Changes to the Terms
  1. The Terms are applied to the Company and customers using the Service. The contents of the Service are as follows.
    1. Residency in SMALL WORLDS TOKYO
    2. Creation of 1 figure (to be set in one of the areas)
    3. Annual passport (valid for 1 year from the day you get it)
      *To customers who purchased on or before July 31, 2020: The validity of Annual Pass is extended to June 30, 2022.
    4. Invitation to the pre-opening (Only for those who made their purchases on or before June 1, 2020. )
  2. The Company may change some of the Terms if it is deemed necessary. By continuing to use our services after those revisions become effective, you agree to be bound by the revised terms. If the Terms are changed, the Company will inform customers a month before the changes will take effect.
Article 2: Terms of Service
  1. Tickets of the Service (hereinafter referred to as the "Service Tickets") are provided only for customers who can make an online purchase.
  2. The Service is designated only for customers who can use computers and the Internet at their own risk and who can operate computers with various settings such as characters displayed in Japanese and e-mails. If the Service is used incorrectly due to customer's equipment, network, OS, provider and other reasons that the Company cannot control, we will not take any responsibility.
  3. To make a purchase, please fill your personal information such as your name and e-mail address in the designated form. We may refuse your purchase application if we determine that you did not fill in all the required information, entered a corrupted text that cannot be identified, provided false or other inappropriate information.
  4. If there are any changes to the information filled into the designated form, customers should promptly inform the Company of the changes by using the method specified by the Company.
Article 3: Prohibited Acts
  1. Customers are prohibited from reselling the tickets to a third party or providing them to a third party for resale, whether it is for commercial purposes or not. It is also prohibited to transfer them to a third party for free for profit.
  2. Customers are prohibited from purchasing the tickets with purpose of reselling them to a third party or providing them to a third party for resale. It is also prohibited to purchase them for the purpose of transferring them to a third party for free for profit.
  3. If you violate item 1 or 2, we will take measures to prevent you from using the Service you purchased. In that case, no refund will be given.
  4. The following acts are prohibited when using the Service.
    1. Acts that infringe or may infringe copyrights, trademark rights, other intellectual property rights, property rights, privacy rights, etc. of third parties (including our company and other customers)
    2. Acts that violate or may violate public order and morals or acts of providing information that violates public order and morals to third parties (including other customers)
    3. Criminal behavior or behaviors that may lead to a crime
    4. Acts of collecting information of other customers of the Service and acts that may cause loss, damage or discomfort to the Company, other customers of the Service or the third parties
    5. Profit-making activities related to the Service carried out without the Company's consent
    6. Illegal use of ID or other identification number, counterfeiting personal information such as customer's name, address, telephone number or e-mail address, etc. or acts of impersonating
    7. Acts of using or providing harmful programs such as computer viruses through the Service or in relation to it
    8. Acts that violate or may violate laws and regulations
    9. Acts that the Company deems inappropriate
  5. If the customer finds out that an act that falls under any of the items above has been made, or if customer determines that there is a risk of such an act being made, they need to inform us immediately.
Article 4: Sales of Service Tickets
  1. The types and prices of services that customers can purchase using the Service are published on the sales page. However, the type of service and its price are subject to change without prior notice at the discretion of the Company.
  2. The time of concluding the sales contract regarding the Service Tickets between the Company and customers is as follows.
    Payment by "credit card": The moment the Company approves the customer's application after confirming that the payment is approved by your credit card company.
  3. The Service requires a 3D scanning. Please come to the venue and undergo a 3D scanning. The 3D scanning will be held till September 30, 2020. We will contact you later regarding the starting date and time of the 3D scanning.
  4. Please be advised that customers with annual passports provided with the Service may still have to wait for admission depending on the degree of crowding and other events.
Article 5: Handing Over of Annual Passport
The annual passports will be handed out on the day of 3D scanning.
The 3D scanning will be carried out until September 30, 2020. They will no longer be available after that date.
Article 6: Payment Methods
Customers should pay the purchase price for the Service Tickets using the payment method specified at the time of purchase ("credit card payment").
  • ・Payment by "credit cards":
    Cards issued by VISA, JCB and Master Card can be used for payment. You can only make a lump-sum payment. Please do not use virtual cards and other credit cards that do not exist.
Article 7: Handling of Annual Passports
Customers become fully responsible for the handling of the annual passports after receiving them, and the Company relieves itself of the responsibility for for these items. In principle, we will not reissue them due to damage or loss.
Article 8: Cancellation and Change
  1. Customers cannot cancel their purchase regardless of types of service and reasons. However, this does not apply to the cases when the purchase is canceled due to legal reasons or proved invalid and customer also agrees with that.
  2. The 3D scanning will be carried out till September 30, 2020. Please come and undergo a 3D scanning during this period.
  3. Please note that there will be no refund if customers do not come within the 3D scanning period.
Article 9: Suspension of Use
  1. If customers fall under any of the following items, the Company will temporarily or permanently suspend them from using the Service without prior notice.
    1. Violation of any of these Terms
    2. When the Company has a substantial reason to refuse the customer's purchase application
    3. When the customer is deemed to be unfit for using the Service by the Company
  2. If customers fall under any of the reasons listed above, they will automatically lose their rights and interests and need to pay off their debt to the Company immediately.
Article 10: Customer Personal Information
The handling of customer personal information by the Company will be subject to the provisions of our Privacy Policy(https://smallworlds-figureprogram.jp/privacy/, and you are agreeing that the Company will handle your personal information in accordance with this Privacy Policy.
Article 11: System
  1. The Company may change or suspend all or part of the system related to the Service (hereinafter referred to as the "System") without prior notice if any of the following situation happens. We are not responsible for any damage caused to customers by this actions.
    1. Urgent System check or maintenance
    2. When the Service cannot be operated due to the problems with computers or communication lines, misoperations, congested network, unauthorized access, hacking, etc.
    3. When the Service cannot operate due to majeure factors such as earthquake, typhoon or other natural disasters
    4. Other cases when the Company determines that the Service needs to be changed or suspended
  2. The Company will bear no responsibility for any problems that occur to customers if their browser is laggy or suddenly crashes, or if customers shut down the computer or disconnect the Internet while using the Service.
  3. The Service is connected to some of sites and servers, other than those of the Company.
  4. The Service uses JavaScript, SSL and Cookie.
Article 12: Attractions and Shows inside the Facility
Attractions, shows, stores, restaurants etc. may be changed or canceled without prior notice on the day of admission at the discretion of the Company. Even in this case, there will be no refund for annual passports.
Article 13: Ownership of Rights
  1. Customers should acknowledge that they do not acquire any intellectual property rights related to the Service.
  2. Customers are not allowed to change the display and the explanation of the intellectual property rights of the Company and our licensors.
  3. If customers have any complaint, objection, claim, etc. (hereinafter referred to as the "Dispute") due to a third party's infringement of the intellectual property rights when they use the Service, they should promptly notify us of the fact of the Dispute. The Company and our licensors will be able to handle the dispute with the third party after the consultation with the customer. Moreover, customers need to cooperate with us after delegating the necessary authority to the Company and our licensors.
  4. If customers infringe the intellectual property rights of the Company or the original right holder while using the Service, customers need to compensate the Company and the original right holder for the loss.
Article 14: Disclaimer of Warranty, Compensation for Damage and Loss
  1. The Company does not make any guarantees regarding the accuracy, completeness, usability, up-to-dateness, commercial availability, suitability for a particular purpose or feasibility for a particular result for the Service.
  2. The Company shall not be liable for any compensation of damages beyond the price of the Service incurred by the customer in relation with the use of the Service.
  3. The Company will not be responsible for any damage caused by the following reasons.
    1. Majeure factors such as earthquake, typhoon and other natural disasters
    2. Failure of the customer's connection environment, such as failure of the customer's equipment or failure of the Internet connection service to the System
    3. Failure caused by the performance value of Internet connection service, such as the response time from the System
    4. The Service system invasion by the types of computer viruses, the virus patterns and virus definition files of which are not provided by the third party which introduced a computer antivirus software to the Company
    5. A third party's unauthorized access or attack to the System and interception of the communication that cannot be prevented even with the due care of a prudent administrator
    6. Failures caused by hardware, software (OS, middleware, DBMS) and database that are not manufactured by the Company
    7. Damage caused by malfunction of telecommunications service provided by telecommunications carrier
    8. Article 218 of the Criminal Procedure Law (detention based on summons, search, arrest warrants), compulsory penalties based on provisions of the law on wiretapping for criminal investigations and other compulsory penalties based on court orders or laws
Article 15: Warranty against Defects
  1. Regarding the service-related items that are handed over to customers (including but not limited to figures, the same shall apply hereinafter), if there is a defect that could not be found by inspection at the time of handover or delivery, and it causes a damage to the customer, the Company will be liable for it only in the case described in the following paragraph.
  2. If customer notify us about defects in items within 3 months from the moment of delivery, and it is confirmed that these defects has been present at the time of handover or shipment, we will consult with customer and provide a replacement or compensation amounting to no more than the price of the Service.
Article 16: Confidentiality
Customers are not allowed to disclose the non-public information related to the Service which customers should keep secret, unless customers get the Company's written consent in advance.
Article 17: Assignment of Rights and Obligations under these Terms
Customers are not allowed to assign the status and any right or obligation stated in the Terms to a third party or set a third party as the guarantor, or make other dispositions, without prior written consent of the Company.
Article 18: Negotiation
If customers have any questions on matters not specified in the Terms or about implementation of the Terms, customers and the Company can negotiate in good faith and try to solve the problem.
Article 19: Governing Law
The establishment, legal validity, interpretation and performance of the Terms should be in accordance with related laws and regulations of Japan.
Article 20: Elimination of Relationships with Antisocial Forces
  1. Before using the Service, customers guarantee that they do not belong to gangs, gang-affiliated companies, racketeer groups, groups engaging in criminal activities under the pretext of conducting social campaigns or political activities, crime groups specialized in intellectual crimes, and other antisocial forces (hereinafter the "Antisocial Forces"). Moreover, customers guarantee that they do not fall under any of the following items and promise they will never fall under them in the future.
    1. Being a member of Antisocial Forces
    2. Having relationships recognized as unfair use of Antisocial Forces
    3. Providing funds to Antisocial Forces while knowing of their origin or having relationship recognized as being involved with them, such as providing accommodation
    4. Having relationships with Antisocial Forces which should be criticized by the society
    5. Engaging in acts of fraud or violence, making unfair demands that are beyond legal liability, using threatening words and engagement in other equivalent acts towards the Company or related parties by yourself or through a third party
  2. If the Company determine that you violate statements or commitments set forth in the preceding paragraphs, the Company will permanently prevent you from using the Service without prior notice.
  3. The Company shall not be liable for any damage caused to the customers by the Company's measures mentioned on the preceding paragraphs. In addition, if damage is caused to the Company by taking such measures, the customer shall compensate for the damage caused.
Article 21: Legal Jurisdiction
If disputes regarding the Terms arise between customers and the Company, the Tokyo District Court will be the exclusive court for the first instance of the legal jurisdiction.
